    Client: “you” or “Client,” the purchaser or participant in TheGonzaFit coaching services.

    By checking the box at checkout, signing an agreement, completing payment, submitting onboarding forms, or beginning coaching, you agree to these Terms.

    1) What You’re Purchasing

    You are purchasing the Lean Life System, a 12-week online coaching program for busy professionals who want to lose fat, build strength, improve consistency, and build a fitness system around their real schedule.

    Investment:

    $2,100 USD for the initial 12-week program, plus any applicable taxes, processing fees, or third-party payment provider fees.

    Payment options may be available at checkout through Stripe, Klarna, or another approved third-party payment provider, if eligible.

    The program may include:

    - Custom training plan

    - Calories and protein targets

    - Weekly coaching/review

    - Progress tracking

    - Habit and accountability support

    - Form review when applicable

    - Travel/hotel workout options when needed

    - Messaging support during business hours

    - General fitness and nutrition education

    The exact payment option selected at checkout, invoice, or written agreement controls the amount due.

    2) Payment Terms

    Payments are processed through Stripe or another approved payment processor.

    You may pay in full or use available payment options at checkout, such as Klarna or another third-party payment provider, if eligible.

    If you use Klarna or another third-party payment provider, your payment relationship with that provider is subject to that provider’s approval process, terms, payment schedule, fees, late fees, and policies.

    TheGonzaFit is not responsible for Klarna approval decisions, installment schedules, late fees, financing terms, or payment issues between you and the third-party payment provider.

    If any payment fails, is reversed, or is disputed improperly, TheGonzaFit may pause coaching access, Trainerize access, programming, check-ins, feedback, and support until the account is current or the issue is resolved.

    To prevent fraud and unnecessary fees, you agree to contact TheGonzaFit first before initiating a chargeback so both parties can attempt to resolve the issue in good faith.

    3) No Automatic Renewal

    The initial Lean Life System is a 12-week online coaching program.

    Coaching does not automatically renew after the initial 12 weeks unless you separately choose and agree to a continuation option.

    Near the end of the initial program, TheGonzaFit may offer continuation options, which may include:

    - Momentum maintenance coaching

    - Momentum+ higher-touch coaching

    - Another 12-week coaching phase

    - Month-to-month coaching

    - A custom continuation option

    Any renewal or continuation requires a separate written agreement, checkout, invoice, or subscription enrollment before billing begins.

    You will not be automatically charged after the initial 12-week program unless you actively choose a continuation option.

    4) 30-Day Money-Back Guarantee

    TheGonzaFit offers a 30-day money-back guarantee from the program start date.

    If you decide the program is not the right fit within the first 30 days, you may request a refund in writing by emailing gonza@thegonzafit.com.

    If you paid through Klarna or another third-party payment provider, the refund will be processed through the original payment method or payment provider according to that provider’s refund process.

    After the 30-day guarantee period, payments are non-refundable unless otherwise required by law.

    The 30-day money-back guarantee applies only to the initial 12-week Lean Life System. It does not apply to future renewals, maintenance plans, continuation programs, or add-on services unless separately stated in writing.

    5) Results Support Guarantee

    TheGonzaFit does not guarantee a specific amount of fat loss, muscle gain, weight loss, strength gain, body composition change, or physical transformation.

    Results vary based on adherence, starting point, health status, training consistency, nutrition consistency, sleep, stress, lifestyle, medications, travel, and other individual factors.

    At the start of the program, Coach and Client will establish realistic progress targets. These may include weight trend, measurements, progress photos, strength improvements, consistency improvements, energy improvements, or other agreed markers.

    If you complete the full 12-week program, complete at least 80% of assigned workouts, food logs, check-ins, habits, and agreed action steps, submit requested progress data, and are not satisfied with progress toward the agreed targets, TheGonzaFit will continue coaching you at no additional coaching fee until meaningful progress toward the agreed targets is achieved, up to a maximum of 6 additional weeks.

    This is a service extension, not a refund.

    This guarantee only applies after the full 12-week program is completed.

    This guarantee does not apply if you:

    - Cancel or request a refund during the 30-day guarantee period

    - Do not complete the full 12-week program

    - Complete less than 80% of agreed actions

    - Have missing or incomplete logs/check-ins

    - Stop communicating or disappear

    - Do not provide requested progress data

    - Have significant unreported illness, injury, medication change, travel interruption, or other circumstance affecting progress

    - Do not follow reasonable coaching adjustments

    - Change the agreed goal after the program begins

    - Expect results outside the agreed targets

    The Results Support Guarantee is available once per client and has no cash value.

    6) Scheduling, Pauses & Availability

    TheGonzaFit designs your plan around your stated availability, goals, equipment access, and schedule.

    You are responsible for communicating schedule changes, travel, missed workouts, injury, illness, or other factors that may affect your plan.

    Pause policy:

    You may request one pause of up to 14 days during the 12-week program with at least 7 days’ notice. Approved pauses extend the program by the same number of paused days.

    Additional or longer pauses may be declined, may not extend the program, or may require an administrative fee, at TheGonzaFit’s discretion.

    7) Client Responsibilities

    You agree to:

    - Provide accurate intake and health information

    - Complete check-ins honestly

    - Log food when assigned

    - Complete assigned workouts or agreed backup workouts

    - Submit progress data when requested

    - Submit form videos when requested

    - Communicate schedule changes, travel, injury, pain, or major lifestyle changes

    - Stop exercising and seek medical guidance if symptoms or concerns arise

    - Use the program for personal use only

    - Not share, resell, copy, distribute, or publish TheGonzaFit materials
    Client agrees to complete all required onboarding documents truthfully and promptly, including the PAR-Q, Liability Waiver, intake forms, and any requested health or readiness information.

    This program does not require perfection. It does require honest communication, consistent effort, and follow-through.

    If life gets busy or something is not working, you agree to communicate instead of disappearing.

    8) Communication Expectations

    TheGonzaFit provides coaching support through Trainerize, email, text, or other agreed communication channels.

    Standard communication hours are Monday through Friday during business hours unless otherwise agreed.

    Messages sent outside business hours may be answered the next business day.

    TheGonzaFit does not provide emergency medical, mental health, crisis, or urgent care support.

    9) Medical Disclaimer

    TheGonzaFit, Argag LLC, Gonzalo, coaches, contractors, and representatives are not physicians, registered dietitians, physical therapists, psychologists, therapists, or licensed medical providers.

    All training and nutrition guidance is for general fitness, education, and lifestyle coaching purposes only.

    It is not medical advice, medical nutrition therapy, diagnosis, treatment, physical therapy, mental health care, or a substitute for care from a licensed provider.

    You should consult a physician or qualified healthcare professional before beginning exercise or nutrition changes if you have any medical condition, injury, concern, medication, pregnancy/postpartum status, or reason to believe exercise may be unsafe.

    10) Online Coaching Disclaimer

    You understand that online coaching is performed remotely.

    TheGonzaFit is not physically present to supervise exercise technique, equipment setup, gym environment, home environment, or your physical condition during workouts unless separately agreed in writing.

    You agree to exercise in a safe environment, use equipment properly, follow gym or facility rules, and stop immediately if you experience chest pain, dizziness, faintness, unusual shortness of breath, sharp pain, severe discomfort, or any symptom that feels unsafe.

    You agree to seek medical attention when appropriate.

    11) Liability Waiver + Assumption of Risk

    You understand that participation in fitness coaching, exercise programming, strength training, cardiovascular training, mobility work, stretching, use of exercise equipment, and related nutrition/lifestyle changes involves inherent risks.

    These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, joint pain, back pain, injury, illness, aggravation of existing conditions, and in rare cases serious injury.

    You confirm that you are voluntarily participating in TheGonzaFit coaching and related exercise activities. You understand and accept the risks associated with participation.

    To the fullest extent allowed by law, you release, waive, and hold harmless TheGonzaFit, Argag LLC, Gonzalo, coaches, contractors, agents, and representatives from claims, demands, damages, liabilities, costs, or expenses arising from your participation in the coaching program, exercise activities, use of equipment, or use of training guidance provided, except where rights cannot be waived under applicable law.

    You understand that this waiver does not waive any rights that cannot legally be waived.

    12) Health Screening / PAR-Q

    Health Screening, PAR-Q, and Liability Waiver

    Before beginning any training, nutrition coaching, habit coaching, or fitness-related program with TheGonzaFit, Client must complete a Physical Activity Readiness Questionnaire (PAR-Q) and sign a Liability Waiver and Informed Consent form.

    Client understands that enrollment, payment, or purchase of the program does not automatically guarantee eligibility to participate. TheGonzaFit reserves the right to review the Client’s PAR-Q, health history, injury history, medical limitations, and any other relevant information before allowing Client to begin the program.

    If the PAR-Q or Liability Waiver is not completed, TheGonzaFit may delay the Client’s start date until all required forms are completed.

    If the information provided indicates that the Client may need medical clearance before participating, TheGonzaFit may require written clearance from a licensed medical provider before beginning or continuing the program.

    If TheGonzaFit determines, in its reasonable judgment, that the Client is not an appropriate fit for the program due to health, safety, medical, legal, or liability concerns, TheGonzaFit may cancel the Client’s enrollment.

    If enrollment is canceled by TheGonzaFit before the Client begins receiving coaching services due to eligibility, medical clearance, or liability concerns, Client may be eligible for a refund of payments made, minus any services, assessments, administrative work, or materials already provided, unless otherwise required by law.

    Client agrees that failure to complete the PAR-Q, failure to sign the Liability Waiver, failure to disclose relevant health information, or providing inaccurate or incomplete information may affect eligibility, delay program start, limit the type of coaching provided, or result in removal from the program without refund after services have begun.

    Client is responsible for providing accurate and complete information and for updating TheGonzaFit if health status, injuries, medications, medical conditions, or physical limitations change during the program.

    13) Facilities & In-Person Work

    Online coaching may be used in any gym, home gym, apartment gym, hotel gym, or other facility that you lawfully access.

    You are responsible for following the rules of any facility you use.

    TheGonzaFit does not conduct in-person sessions inside facilities that prohibit external trainers. If any hybrid, in-person, or add-on session is agreed to in the future, the session must occur at an approved location and may include additional fees or travel fees.

    14) Communications, SMS, and Email

    You consent to reasonable email, SMS, app, and coaching-related messages from TheGonzaFit, including reminders, check-ins, program updates, scheduling messages, and service-related communication.

    You may opt out of marketing emails at any time.

    If SMS opt-out is available, you may reply STOP to stop receiving text messages. However, opting out of service-related communication may affect coaching delivery.

    15) Privacy, Photos, Videos, and Testimonials

    TheGonzaFit collects client information to deliver coaching, personalize training/nutrition guidance, process payments, communicate, track progress, and improve services.

    Information collected may include name, email, phone number, intake answers, goals, training logs, nutrition logs, steps, progress photos, form videos, scheduling information, and payment records.

    Payments are processed by third-party providers such as Stripe. TheGonzaFit does not store full card numbers.

    TheGonzaFit does not sell client data.

    Progress photos, videos, testimonials, and identifiable client information are private by default and will not be shared publicly without written consent.

    You may request access, correction, or deletion of personal data by emailing gonza@thegonzafit.com, subject to legal, tax, accounting, and business record retention requirements.

    16) Intellectual Property

    All programs, workouts, videos, templates, PDFs, guides, messages, and resources provided by TheGonzaFit are owned by TheGonzaFit or licensed to TheGonzaFit.

    You receive a personal, non-transferable license to use them for your own fitness only.

    You may not copy, sell, distribute, publish, share, or use TheGonzaFit materials for commercial purposes without written permission.

    17) Age Requirement

    You must be 18 years of age or older to purchase or participate in TheGonzaFit coaching.

    By purchasing or participating, you confirm that you are at least 18 years old.

    18) Updates to These Terms

    TheGonzaFit may update these Terms prospectively.

    The version linked at checkout, signed by you, or otherwise agreed to at the time of purchase controls your initial program unless both parties agree otherwise in writing.

    19) Disputes and Governing Law

    These Terms are governed by the laws of the Commonwealth of Massachusetts.

    The parties agree to attempt to resolve disputes informally and in good faith before pursuing formal legal action, except where urgent legal relief is necessary.

    If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

    20) Final Agreement

    By checking the box at checkout, signing an agreement, completing payment, submitting onboarding forms, or beginning coaching, you confirm that you have read, understood, and agree to these Terms.

    You understand that:

    - The initial program is 12 weeks

    - The investment is $2,100

    - Coaching does not automatically renew unless separately agreed

    - You have a 30-day money-back guarantee

    - The Results Support Guarantee requires full program completion and at least 80% adherence

    - The Results Support Guarantee provides up to 6 additional weeks of coaching, not a refund

    - Exercise involves risk

    - TheGonzaFit provides fitness coaching and education, not medical care
