TheGonzaFit Coaching Agreement (Terms of Service)

Client: “you” (the purchaser).
By checking the box at checkout and completing payment, you agree to these Terms.
1) What you’re purchasing today
Busy Pro Recomp — 12 weeks of online coaching for busy professionals.
One-time payment: $1,999 USD due today (plus any applicable taxes/fees).Includes: Custom training (~3 hrs/week), calories + protein targets, daily micro check-ins, weekly video feedback (8–12 min), form reviews, travel/hotel plans, and messaging support during business hours (Mon–Fri).
2) What happens after 12 weeks (auto-continue)
After 90 days from purchase (≈12 weeks), your membership begins automatically on Momentum (Standard) at $349 USD/month, billed monthly until canceled. If you’d like the higher-touch option after 12 weeks, you may switch to Momentum+ at $699 USD/month in your Customer Portal.
Changes made during the 90-day free trial take effect when the trial ends; changes made after billing has begun take effect on your next billing date. You can cancel anytime in the Customer Portal before the trial ends (and at any time thereafter).
If our public rates change, we will provide at least 30 days’ notice before any increase applies to your membership, and you may cancel before the change takes effect.The card you use today will be stored and charged automatically.
You can cancel any time before the Momentum start date (and at any time thereafter) using the Customer Portal link in your Stripe receipt/confirmation, or by emailing gonza@thegonzafit.com .
Please allow 2 business days for cancellation requests sent by email/text to be processed.
If you enrolled via a link without auto-continue: this section doesn’t apply. We will invite you to opt-in to Momentum near week 10–12.
3) Scheduling, Pauses & Availability
We design your plan around your stated availability.
Pause policy: one pause up to 14 days during the 12-week program with 7 days’ notice. Pauses extend the program by the same number of paused days. Additional/longer pauses may be declined or require an admin fee.
Momentum: you may pause/cancel anytime through the Customer Portal (billing does not prorate mid-cycle unless required by law).
4) Refunds & Chargebacks
If coaching hasn’t started (no plan delivered), you may request a refund within 3 business days of purchase.
Once kickoff materials are delivered or coaching begins, payments are non-refundable.
To prevent fraud and unnecessary fees, you agree not to initiate a chargeback without first contacting us to resolve any issue in good faith.
5) Payments & Failed Charges
You authorize us (via Stripe) to store your card and auto-charge per the plan selected.
If a Momentum payment fails, Stripe may retry; please update your card within 3 days to avoid interruption. We may suspend service until payment is current.
6) Results, Adherence & Guarantee
Results vary based on adherence, health, stress, sleep, and other factors. We don’t promise specific fat loss/muscle gain outcomes.
Adherence-Based Goodwill Extension
If you meet the adherence criteria and feel you didn’t progress toward the agreed focus, we’ll extend coaching time at no extra coaching fee (service time only, not a refund).
Eligibility (all must be true):
Training: ≥ 85% of assigned sessions completed over 12 weeks.
Check-ins: ≥ 85% of weekly check-ins submitted on time with requested data.
Nutrition/steps (if assigned): ≥ 85% of days within your calorie target (±100 kcal) and hitting protein (±10%) and step target (±10%).
Evidence: adherence is shown in your app/logs/videos.
How to request: Email support@thegonzafit.com within 7 days after week 12. We’ll review your logs together.
What we provide:
An additional 4 weeks of coaching with plan adjustments.
If you maintain ≥85% adherence during those 4 weeks and still haven’t hit the week-1 agreed outcome metrics (set in writing—e.g., waist change, strength reps/loads, or other KPIs), we may add one more 4-week block (maximum 8 weeks total) at our discretion.
Limits & exclusions:
One goodwill extension per client/lifetime; non-transferable; no cash value.
Not available if there are gaps >14 days, illness/injury, new medications, travel that prevents training, or incomplete/missing logs.
This is a service guarantee, not a specific body-composition guarantee or refund.
7) Health & Safety
We are not medical providers; coaching is educational/fitness guidance only.
You confirm you are medically cleared for exercise, will train in a safe environment, and will stop any activity that causes pain/dizziness and seek medical advice if needed.
Assumption of risk & release: You understand exercise involves inherent risks and release and hold harmless TheGonzaFit and its coaches from claims arising from ordinary negligence. This does not waive rights that cannot be waived by law.
8) Facilities & In-person Work
Online coaching may be used in any gym you lawfully access.
We do not conduct in-person sessions inside facilities that prohibit external trainers (e.g., certain private clubs). If you choose Momentum+ or a hybrid add-on in the future, sessions occur at approved locations (e.g., your building gym, private studio, or outdoor space) and may include travel fees.
9) Your Responsibilities
Provide accurate intake info; complete weekly check-ins; submit requested form videos; communicate travel/injury changes promptly.
Use provided programs for personal, non-commercial use only; do not share or resell materials.
10) Communications & Media
You consent to reasonable email/SMS/app messages related to your coaching (reminders, check-ins, updates). You can opt out of marketing emails anytime.
Progress photos/testimonials are private by default. We will never share your images or identifiable information publicly without your written consent.
11) Intellectual Property
All programs, videos, templates, and resources remain TheGonzaFit’s intellectual property. You receive a personal, non-transferable license to use them while a client.
12) Miscellaneous
You must be 18+ to enroll. If any term is unenforceable, the rest remain in effect.
We may update these Terms prospectively; the version linked at checkout controls for new purchases.
By completing checkout, you agree: $1,999 today for Busy Pro Recomp; Momentum begins at $349/month after 90 days unless you cancel before the start date via the Customer Portal or by contacting us.
